Terms of Service

1. Agreement to Terms

By accessing or using OnPremEasy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

The Service is operated by OnPremEasy ("we", "us", "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

OnPremEasy provides an on-premises infrastructure cost calculator that generates sizing recommendations and cost estimates for server deployments. The Service uses product profiles, pricing data, and AI-powered analysis to produce recommendations.

Recommendations are estimates provided for planning purposes. Actual infrastructure costs may vary based on vendor pricing changes, configuration decisions, and deployment specifics. The Service does not guarantee the accuracy or completeness of any recommendation.

3. Accounts and Registration

To access certain features, you must create an account by providing a valid email address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information and to notify us promptly of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Token-Based Billing

The Service operates on a token-based billing model:

  • Each verified account receives a limited number of free calculations.
  • Additional calculations require purchased token packs.
  • One token equals one successful calculation that produces a recommendation.
  • Tokens are non-transferable between accounts unless otherwise specified.
  • Purchased tokens do not expire.

Token pack prices are listed on our pricing page. We reserve the right to change pricing for future purchases. Existing purchased tokens are not affected by price changes.

5. Payments and Taxes

Payments are processed by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for all purchases. By completing a purchase, you also agree to Paddle's Terms of Use and Privacy Policy.

All applicable taxes (including VAT, GST, and sales tax) are calculated and collected by Paddle based on your location. Prices displayed may be exclusive of tax unless stated otherwise.

6. Refunds

Refunds are available under the conditions described in our Refund Policy. By making a purchase, you acknowledge and agree to the terms of our Refund Policy.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to any part of the Service or its systems.
  • Use automated tools (bots, scrapers) to access the Service without our written permission.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Resell, redistribute, or sublicense the Service or its outputs without authorization.
  • Submit false or misleading information to manipulate recommendations.

8. Intellectual Property

The Service, including its design, code, product profiles, pricing data, and recommendation algorithms, is our proprietary property or that of our licensors. You may not copy, modify, or distribute any part of the Service except as expressly permitted.

Calculation results generated for your account are yours to use for your internal business purposes, including sharing with colleagues and stakeholders.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

RECOMMENDATIONS AND COST ESTIMATES ARE PROVIDED FOR INFORMATIONAL AND PLANNING PURPOSES ONLY. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY RECOMMENDATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. Unused purchased tokens may be refunded at our discretion in accordance with our Refund Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OnPremEasy is incorporated, without regard to conflict of law principles.
